Shop & Establishment Registration

The Andhra Pradesh Shops and Establishments Act 1988 mandates registration for every shop, commercial establishment, residential hotel, restaurant, eating house, theatre, and other place of public amusement or entertainment within the state, regardless of the number of employees. Even establishments with zero employees must register within 30 days of commencement of business under Section 3 of the AP Shops and Establishments Act 1988. Factories covered under the Factories Act 1948 and establishments of the Central Government are excluded from the Act's purview. Home-based businesses with no customer-facing premises fall in a grey area and should seek a ruling from the local Inspector.

Under Section 14 of the Andhra Pradesh Shops and Establishments Act 1988, no employee in a commercial establishment shall be required to work more than 8 hours in a day and 48 hours in a week. Overtime work is permissible up to a maximum of 50 hours per quarter per employee under Section 18, and employees must be paid overtime wages at twice the ordinary rate of wages for such hours worked. Every employee is entitled to one day of rest per week under Section 17 of the Act. Violation of these provisions by the employer is an offence under Section 53 of the Act attracting fine up to Rs 500 per violation, with enhanced penalties for repeated offences.

An application in Form A under Rule 3 of the Andhra Pradesh Shops and Establishments Rules 1990 must be filed with the Inspector of the local area within 30 days of opening. Required documents include proof of establishment address (rental agreement or ownership document), identity and address proof of the proprietor or managing partner/director, a declaration of the nature of business, and details of the number of employees. After inspection and verification, the Inspector issues a registration certificate in Form B under Rule 4 which must be prominently displayed in the premises under Section 4 of the AP Shops and Establishments Act 1988. The registration must be renewed annually in Form C before expiry.

Andhra Pradesh has integrated Shops & Establishments registration with the AP Labour Management System (APLMS) portal under the AP Ease of Doing Business reforms, allowing online filing of Form A. However, the Inspector retains the power to physically inspect premises within a reasonable period after online registration, as the inspection power under Section 51 of the Andhra Pradesh Shops and Establishments Act 1988 is not extinguished by online filing. The digitally issued registration certificate in Form B carries the same legal validity as a physically issued certificate. Employers must ensure their online submission reflects accurate employee count and business hours, as discrepancies found during inspection attract penalties under Section 53.

Under Section 22 of the Andhra Pradesh Shops and Establishments Act 1988, every employee who has worked for at least 240 days in a year is entitled to annual earned leave at the rate of one day for every 20 days of work. Sick leave of 12 days and casual leave of 12 days per year must also be provided under Section 23 of the Act, though these cannot be accumulated. Female employees are entitled to maternity leave as per the Maternity Benefit Act 1961, which provides 26 weeks of paid maternity leave for establishments with 10 or more employees under Section 5 of that Act. Employers must maintain a leave register in the prescribed form and display the leave rules in the establishment under Rule 19 of the Andhra Pradesh Shops and Establishments Rules 1990.
